CIVIL/PROBATE

Civil cases deal not with any criminal action, but rather with disputes between private parties. The legal definition of civil case is "a personal action which is instituted to compel payment or the doing of some other thing which is purely civil." The end purpose of most civil cases is to obtain a judgment for money, but judgment is also sought to either compel or enjoin some action. 

          Probate - The term probate translates from Latin literally as "proof" and has come to mean the act or process of proving a will in Texas legal procedures. Jurisdiction of probate courts in Texas includes probate matters and matters involving the guardianship of incapacitated persons and minors.

          Probate and guardianship cases deal neither with crimes nor damages, but with protecting the wishes, rights, and obligations of persons regarding their property when these persons are unable to do so as a result of death or incapacitating illness, either physical or mental.
